Welcome to Concierge at The Residence. By accessing or using our property management portal and services, you agree to be bound by these Terms & Conditions. Please read them carefully.

1. Acceptance of Terms

By creating an account, logging in, or using any features of the Concierge at The Residence portal ("Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy.

2. Description of Service

Concierge at The Residence provides a property management portal for tenants, vendors, and property managers at properties managed by Pittston Properties. The Service includes:

• Maintenance request submission and tracking
• Communication between tenants, vendors, and property management
• Access to lease documents and property information
• Rent payment information and links
• Community resources and local information
• SMS and email notifications

3. User Accounts

To access the Service, you must:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years of age

You are responsible for all activities that occur under your account.

4. SMS/Text Message Terms

By providing your phone number and using the Service, you expressly consent to receive SMS text messages from Concierge at The Residence regarding:

• Maintenance request updates and scheduling confirmations
• Emergency notifications affecting your unit or building
• Important property management announcements
• Appointment reminders and vendor arrival notifications

Message Frequency: Message frequency varies based on your activity and property events. You may receive multiple messages per week during active maintenance requests.

Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan.

Opt-Out: You may opt out of non-emergency SMS messages at any time by contacting us at pittstonproperties@gmail.com or calling 570-814-4024. Note that opting out may affect our ability to provide timely service updates.

5. User Responsibilities

When using the Service, you agree to:

• Provide accurate information in maintenance requests and communications
• Use the Service only for legitimate property management purposes
• Not submit false, misleading, or fraudulent information
• Not attempt to gain unauthorized access to any part of the Service
• Not use the Service to harass, threaten, or harm others
• Comply with all applicable laws and regulations

The Service may contain links to third-party websites and services, including utility providers, payment platforms, and local businesses. These links are provided for convenience only. We do not control, endorse, or assume responsibility for any third-party content or services. Your use of third-party services is at your own risk and subject to their terms and policies.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Information provided through the Service, including local resources, utility contacts, and community information, is for convenience only and may not be current or accurate. Users should verify important information independently.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONCIERGE AT THE RESIDENCE, PITTSTON PROPERTIES, AND THEIR OWNERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

This includes, but is not limited to, damages arising from:

• Delays in maintenance response or repairs
• Inaccurate information provided by third parties
• Service interruptions or technical issues
• Unauthorized access to your account
• Use of third-party services linked from our platform

9. Indemnification

You agree to indemnify and hold harmless Concierge at The Residence, Pittston Properties, and their owners, agents, and affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms & Conditions from time to time. Continued use of the Service after changes constitutes acceptance of the modified terms.

11. Termination

We may terminate or suspend your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination of your tenancy, your access to the tenant portal will be deactivated.

12. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Luzerne County, Pennsylvania.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and Concierge at The Residence regarding your use of the Service.
